The Law of Dependants’ Relief in Canada KN125.81 H37

These two books may be read in tandem. The first, The Law of Dependants’ Relief in British Columbia is a highly respected treatise on wills variation.  It provides a detailed analysis of the state of the law in BC prior to the Supreme Court of Canada’s 1994 decision in Tataryn v. Tataryn Estate and continues to be useful for many matters not affected by the Tataryn decision.  The Law of Dependants’ Relief in Canada extends the analysis to jurisdictions across Canada and reviews post-Tataryn jurisprudence from all provinces including BC.  It also includes a discussion of procedural matters such as who can apply for relief, bars to applying and limitation periods.
