NS Supreme Court Decision: Correcting a Will


The Sydney registry of the Supreme Court of Nova Scotia recently released the following decision: 

Re: Peach Estate 2009 NSSC 383 (CanLII) Docket: Probate No. 21051 (Wills; Religion; Errors)

Judge cited falsa demonstratio and determined deceased had intended to restrict sale of property to "Anglican or Protestant," despite will reading "Anglican of Protestant."  However such a restriction is not permitted under the Nova Scotia Human Rights Act, so the clause was rendered void.
