Toolkit for Lawyers Navigating Section 276 and 278 Criminal Code Matters as Complainant Counsel in Criminal Proceedings

On April 28, 2020 West Coast LEAF released a toolkit for lawyers navigating section 276 and 278 Criminal Code matters as complainant counsel in criminal proceedings.

The Toolkit ( ) sets out the law surrounding the admissibility of evidence of a survivor’s past sexual activity and the production of third-party records for criminal proceedings. It also provides an overview of the evolution of this area of law, practical advice for advancing these sexual assault cases, and guidance on developing a trauma-informed practice.

Interested lawyers are invited to attend a complimentary webinar organized by West Coast LEAF and hosted by Courthouse Libraries BC on Tuesday, May 19, 2020 from 4:30-6:30pm. The webinar, A Panel Discussion: Navigating section 276 and 278 Criminal Code matters for complainant counsel in criminal proceedings, ( will build on the information set out in the toolkit and provide lawyers with the opportunity to ask questions about navigating these complex matters in a trauma-informed and survivor-centred way.
