Supreme Court of Canada decisions: Constitutional Right to Protection of Aboriginal Interests

The Supreme Court of Canada released the following decision:

Ktunaxa Nation v. British Columbia (Forests, Lands and Natural Resource Operations), 2017 SCC 54, File no. 36664

(Constitutional law — Charter of Rights  — Freedom of religion — Aboriginal rights — Crown — Duty to consult — First Nation alleging that ski resort project would drive spirit central to their religious beliefs from their traditional territory — Provincial government approving ski resort despite claim by First Nation that development would breach right to freedom of religion — Whether Minister’s decision violates s. 2 (a) of Canadian Charter of Rights and Freedoms .)
