Finding Commentary on Precedents Using CLE Online

- [Rebecca] Hi, I'm Rebecca.

- [Meghan] And I'm Meghan. In this video, we'll show you how to find a precedent, within the larger context of the practice material and commentary in the CLE collection. Basically, we'd like to demonstrate how to find not only a precedent, but any information the CLE may have on how to use it.

- [Rebecca] To show you all of this, I'm going to help Meghan find material for a client file she's been working on. Last week Meghan asked me about finding a specific precedent called the Halliday Order.

- [Meghan] As I started drafting, it occurred to me that I'd love to see what kind of supporting material the CLE might have to assist me, so I've come back for a second look. My client, Ms. Ella was involved in a carriage accident late one night and we are pursuing the manufacturer of the single use vehicle for damages. Ms. Ella has been asked to produce her medical records, but we are concerned about some privileged documents. I'm looking to find information on a Halliday Order. I'd like to find not only precedents, but commentary about using these types of orders.

- [Rebecca] CLE has a few different sources that might help, so in order to get a glimpse at everything, I'd like to suggest that we do a cite wide search using the search box at the top left of the screen. In this case I'd start with Halliday Order.

- [Meghan] Wow, 40 results. What kind of materials are we looking at?

- [Rebecca] The list on the left titled Filter by Content Types shows you where your results are coming from. If you select the drop down on the Publications heading, you'll see the titles of the books that discuss Halliday Orders.

- [Meghan] Interesting. I wouldn't have thought to look in some of those titles.

- [Rebecca] While you can limit it by filter, lets take a quick look at the results, since it defaults to your results by relevance. While not full proof, it's often a good way to see leading discussions of your topic.

- [Meghan] Yeah, okay, looking through this list, I'm really interested in that fourth entry, Use Halliday Order. Can we take a look at that one?

- [Rebecca] Absolutely. You'll see that the page from the book has loaded on the right. One thing to watch out for is that you're actually viewing the top of the page. And you'll need to scroll down further in this case to see your section. Also remember to keep an eye on the detailed Table of Contents that appears on the left.

- [Meghan] Yes, okay I can see there's a section on Halliday problems, I would certainly want to read that section.

- [Rebecca] You can click on any of the sub-headings to go directly to that section. But just remember when you do, that you'll lose the highlighted terms from your original search.

- [Meghan] So this is great, but I have a question. What if I've been reading through the practice manual on my own and then I decided I wanted the precedents, can I still find them here?

- [Rebecca] You have two options for this. To demonstrate the first, lets go back to the section on Use Halliday Order, where you'll see that the text refers to a standard precedent found at FP 11. Clicking here takes you straight to the order. The other really nice feature of the practice manuals is that they have a drop down titled Forms & Precedents, that contain all of the precedents located in this text. It's really similar to the tab at the back of the print volumes with the Forms & Precedents. You'll see a list that you can quickly scan for available precedents.

- [Meghan] Okay, this is a nice way to spot additional precedents I might not have thought to search for. So, I think I'm feeling comfortable in the manuals, are there other sources that I should be looking at for commentary.

- [Rebecca] I think it's worth running your search one more time to see the other sources of information for commentary. There's the Case Digests, Course Materials, and Practice Points, which can all be a great source of updates.

- [Meghan] Good idea. So what are the Case Digests?

- [Rebecca] You'll see if I selected just CDs, you'll get a list of short summaries of cases that have come out in recent years, regarding Halliday Orders.

- [Meghan] Oh, that's great. That's a really efficient way to review a lot of case law at once.

- [Rebecca] Exactly.

- [Meghan] What about the other two you mentioned?

- [Rebecca] Our search also turned up results in the Course Materials, and though it didn't turn up this time, sometimes Practice Points are included in search results.

- [Meghan] That's also really helpful as it gives me some insight into how some of my colleagues have dealt with these issues. Rebecca, thank you again for your always outstanding help.
