Post Nov 15, 2019 - Changes in legislation affecting land title transfer forms

Land title forms were recently affected by amendments to the Land Title Act, R.S.B.C. 1996, c. 250, which were brought into force by B.C. Reg. 171/2019 on November 15, 2019 under the Land Statutes Amendment Act, 2018, S.B.C. 2018, c. 37, s. 18 (Bill 37).

Key changes to legislation include the repeal and replace of Part 10.1 - Electronic Filing, including revised terminology, elimination of unnecessary true copy requirements and elimination of duplicative provisions related to e-filing of applications, instruments and plans.

Pre Nov 15, 2019 - Changes in legislation affecting land title transfer forms

The Land Title Act, R.S.B.C. 1996, c. 250, sections 9 and 168.111 authorize the Director of Land Titles to approve forms that must be used by applicants when making applications under the Act.

The following provisions of the Land Title (Transfer Forms) Regulation (B.C. Reg. 53/90) were repealed by B.C. regulations 332/2010 and 339/2010, in force January 1, 2011:

  • the definition of "Act" in section 1
  • section 7
  • section 8 (3) and (4)
  • section 9
  • Schedule B

Effective January 1, 2011 the following provisions were removed from this regulation (B.C. Regulation 53/90) as they concerned matters over which the Lieutenant Governor in Council no longer has regulation-making authority:

  • section 1, other than the definition of "Act"
  • sections 2 to 6
  • 8 (1) and (2)
  • 10 and 11, and
  • Schedule A.

Effective January 1, 2011, all of the hardcopy land title forms from former B.C. regulations have been reissued by the Director of Land Titles and posted on Land Title Forms on the LTSA website.
 
The Land Title Act forms formerly set out in B.C. Land Title Act Regulation 334/79 and B.C. Land Title Act Regulation 53/90 are reissued in Appendix I and II of the Director's Requirements DR 04-11: Director's Requirements and Approval for Hardcopy Land Title Forms and Plans (initially issued as Practice Bulletin 01-10: Director’s Requirements and Approvals of Hardcopy Land Title Forms and Plans). They are approved by the Director of Land Titles for the purposes of the Act and must be used where applicable, except where indicated in Appendix I as not compulsory. 

The forms retain their previous number or letter designations.

The remainder of land title transfer forms completion instructions formerly located in B.C. Regulation 53/90 are moved to Director of Land Titles Directions and Director's Requirements for Hardcopy Land Title Transfer Forms.
