Canada’s Intellectual Property Law was originally written to serve the need for an accessible introduction to the increasingly important, complex, and rapidly growing field of industrial and intellectual property law in Canada. Heavily footnoted, this text provides an accessible approach to understanding and researching intellectual property issues in copyright, trademark, patent, industrial design, and the law of confidentiality as well as more specialized fields. In-depth coverage of complementary areas of law, such as restrictive covenants, privacy, and domain names, are also included.

This text covers key developments in the law, including the commitments Canada has made in respect of the Comprehensive Economic Trade Agreement (CETA) with the European Community, the United States-Mexico-Canada Agreement (USMCA), which replaces the North American Free Trade Agreement (NAFTA), and the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), formerly the Trans-Pacific Partnership. As a result of increasing law reform resulting from trade agreements, the text covers specialized areas such as the Patented Medicines (Notice of Compliance) Regulations, the Patented Medicine Prices Review Board, and Data Protection.

This new edition of The Law of Equitable Remedies significantly expands upon earlier editions by incorporating more case references and enhanced discussions of the most salient cases. Changes include:

  •  Chapters on interlocutory injunctions fully discuss the Supreme Court’s new revisions to the standard for interlocutory mandatory injunctions.
  • Chapters on asset preservation orders (Mareva Injunctions) and search orders (Anton Piller Orders) have been revised to account for new decisions that respond to current developments in the digital universe.
  • Chapters on specific performance have been significantly revised.
  • Chapters on equitable damages and equitable compensation have been rewritten to reflect recent developments of the UK Supreme Court on the former, and of the Supreme Court of Canada in Southwind v Canada and the Ontario Court of Appeal in Stirrett v Cheema on the latter.
  • The chapter on rectification incorporates the Supreme Court’s decision in Canada v Fairmont Hotels.

As with past editions, the new edition is designed to provide judges, practitioners, and students an accessible but comprehensive review of all the relevant cases on equitable remedies, as well as give context and analysis of the history and methods of equity in the common law of remedies.

The Law of Limitations, 4th Edition / Graeme Mew

The Law of Limitations, 4th Edition provides an essential update on the law of limitations in Canada since the previous edition was published in 2016. Readers will benefit from a review of the legislative and common law developments in this fundamental area and will glean insight into the crucial question that litigators representing clients in a range of legal conflicts face on a regular basis: when is it too late to file a suit?

In this comprehensive treatise, The Honourable Mr. Justice Graeme Mew, Debra Rolph and Daniel Zacks offer expert commentary that begins with the general legal principles and history underlying time limitations in all jurisdictions across Canada, as well as an outline of the historical pressures that shaped this important legal area. The authors then shift the focus to an analysis of limitation periods specific to personal actions, actions involving real property and the limitations associated with specific parties such as proceedings by and against the government. Finally, they explore the impact of The Charter of Rights and Freedoms, and in particular, how the section 15 equality guarantee has affected the application of limitation periods for different classes of litigants.
