Courthouse Libraries BC is proud to support the Criminal Defence Advocacy Society (CDAS) in presenting: A Guide to the Collateral facts Bar.
The collateral facts bar is a rule of evidence that prohibits a party from leading evidence to contract an opposing party's witness on a collateral matter. The rule can be perplexing because of the challenges in determining when a factual matter is "collateral" so as to engage the rule. This presentation will review two approaches to determining whether a factual matter is collateral: the traditional approach advocated by Wigmore and other scholars and judges of the last century, and the principled approach more recently proposed by some Canadian scholars and judges. I will argue in favour of the traditional approach; however, the purpose of the presentation is not to definitively settle the debate between the two views but to clarify the issues at stake and to provide an opportunity for discussion.
